"The decision to deport Sharawna to Gaza amounts to a forcible deportation, and deportation of protected persons is prohibited under the Geneva Convention."

The deportation to Gaza of hunger-striking prisoner Ayman Sharawna is a violation of the Geneva Conventions, a Palestinian rights group said Monday.

“The Palestinian Center for Human Rights (PCHR) condemns the deportation of Palestinian detainee, Ayman Sharawna, by the Israeli forces to the Gaza Strip on Sunday, 17 March 2013, under a deal whose details have not been unveiled.”

“PCHR believes that the decision to deport Sharawna to Gaza amounts to a forcible deportation, and reminds that deportation of protected persons is prohibited under Article 49 of the Geneva Convention Relative of the Protection of Civilian Persons in Time of War (Fourth Geneva Convention).”

According to the deal, Sharawna would stay in Gaza for 10 years before being able to return to his home in Hebron.

Sharawna, 36, is from the southern West Bank city of Hebron, and is married with nine children.

Once he arrived to Gaza, Sharawna was transported to Shifa Hospital in Gaza City, and was admitted into the intensive care unit, as his health condition deteriorated.

Sharawna served ten years in Israeli prisons, before he was released in a prisoner exchange deal on 18 October 2011, in which 477 prisoners were released in exchange for the release of IOF soldier Gilad Shalit, who was captured by Hamas. Most of released prisoners had been convicted with long sentences.

On 31 January 2012, Ayman was again arrested without charge or trial, based on a “secret administrative file” which states that he breached the terms of the exchange deal.

In response to the arrest, Ayman announced an open hunger strike on 1 July 2012, demanding his immediate release.

A 2011 prisoner swap deal between Israel and Hamas saw 40 Palestinians deported to other countries and 163 to the Gaza Strip, PHCR said, calling for all deportees to be allowed to return home.

Palestinian Human Rights Group on Thursday outraged at Israeli authorities "disregard" of the immediate danger of the health conditions of 2 Palestinian hunger strikers.

Palestinian Human Rights Group, Addameer, on Thursday expressed outrage at Israeli authorities “disregard” of the immediate danger of the health conditions of Mahmoud Sarsak, currently on his 74th day of hunger strike, and Akram Rikhawi, currently on his 50th day of hunger strike.

The two Palestinian hunger strikers, Al-Sarsak and al-Rekhawi are being held in Ramle prison clinic and the Israeli prison service is refusing to transfer them to a civilian hospital.

“Despite the urgency of their conditions, the Israeli Prison Service (IPS) is still denying access to independent doctors from Physicians for Human Rights-Israel (PHR-Israel) to visit them and refusing to transfer them to civilian hospitals for proper treatment,” Addameer said. Israeli District Court gave the IPS as much as a 12-day period from yesterday, 30 May, to permit the access of the independent doctors to both prisoners. PHR-Israel, Addameer and Al-Haq Human Right Groups condemned the IPS’ blatant breach of health rights and the Israeli District Court’s disregard of the immediate danger to their lives.

An appeal on behalf of Mahmoud and Akram was submitted by PHR-Israel to the District Court on 24 May to demand an immediate visit by independent doctors. The judge granted the IPS until 10 June to allow independent doctors access to both prisoners, in complete disregard of their grave health conditions and the possibility that time is running out. According to the World Medical Association, in most cases death occurs between the 42nd and 72nd days of hunger strike.

“The IPS medical center is not a hospital and is not properly equipped to handle the physical deterioration and effects of long-term hunger strike, in addition to the fragile recovery period post-hunger strike. Furthermore, in a civilian hospital there are better opportunities for creating conditions that will allow open and trustworthy dialogue between doctor and patient. Such dialogue may be essential in bringing about an agreed upon resolution, and save the lives and health of the patients,” Addameer said.

Amnesty International (AI) today issued a call for urgent action from individuals around the world to contact Israeli authorities about Bilal Diab and Thaer Halahleh, two Palestinians men who are at immediate risk of death on their 67th day of hunger strike.

Amnesty International (AI) today issued a call for urgent action from individuals around the world to contact Israeli authorities about Bilal Diab and Thaer Halahleh, two Palestinians men who are at immediate risk of death on their 67th day of hunger strike. Both are being held without charge or trial by Israel.

According to Amnesty’s urgent call, “Two Palestinian hunger strikers’ lives are in danger, as the Israeli Supreme Court has delayed ruling on the appeal against their detention without charge or trial. Other administrative detainees on hunger strike are still denied access to independent doctors.”

“Bilal Diab and Thaer Halahleh’s petition to the Israeli Supreme Court against their administrative detention was heard on 3 May, but the judges have yet to issue a decision. Both have been on hunger strike since around 29 February, and both have told their lawyers that they have been ill-treated by Israel Prison Service (IPS) staff and physicians,” Amensty added.

The alert also raises the cases of Hassan Safadi, Omar Abu Shalal, Jaafar Izz al-Din, and Mahmoud Sarsak, hunger strikers who remain at Ramleh prison clinic and have not been allowed to see independent doctors.

Amnesty urges everyone reading their action alert to contact Israeli authorities using the addresses they provide to demand the release of the men.

Amnesty International has repeatedly urged Israel to end the practice of administrative detention (including detention under the Unlawful Combatant Law), as it has stated that it violates the internationally recognized right to a fair trial, which must be upheld for all detainees, including those accused of violence, even under states of emergency.

A senior United Nations official expressed his concern friday by reports about the critical condition of the two Palestinians being held by Israel and urged the Government to preserve the health of the prisoners

At least 1,550 Palestinians in Israeli jails are now taking part in a mass hunger strike, Israel’s Prison Service said on Wednesday.
